1. User Accounts & Security

To access certain features (including the Shopping Bag, Community Forums, and Order History), you must register an Account.

• Accuracy & Verification: You agree to provide accurate registration details (valid email and date of birth) and complete the mandatory 6-digit email verification process during account creation.
• Unique Accounts: Usernames and email addresses are strictly unique to 1 account only.
• Username Conduct: Usernames (e.g., @username) must not be impersonating, defamatory, infringing, or offensive. Enchackal Technologies reserves the right to reclaim or rename any username in violation of this standard.
• Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized access.

2. Software Licensing (Evolve Access, Quizzie & Platforms)

Software applications provided by Enchackal Technologies are licensed, not sold:

• License Grant: Subject to these Terms and active subscription standing, Enchackal Technologies grants you a non-exclusive, non-transferable, revocable license to access and use our software platforms for personal, educational, professional, or organizational purposes.
• Restrictions: You shall not reverse-engineer, decompile, disassemble, rent, lease, sub-license, or create derivative works from our software, nor attempt to circumvent license authentications.
• Uptime & Service Availability: While we strive for 99.9% cloud availability, services are provided "AS IS" and "AS AVAILABLE" with scheduled maintenance windows communicated in advance.

3. Product Store & Payment Terms

Transactions conducted through our Product Store are subject to the following billing terms:

• Payment Gateway: All payments are processed securely through Stripe. You authorize Stripe and Enchackal Technologies to charge your designated payment method for the full purchase amount, applicable taxes, and shipping fees.
• Order Fulfillment: Physical orders and software licenses are fulfilled promptly upon successful payment verification.
• Cancellations & Refunds: You may cancel physical orders prior to shipment for a full refund through our customer support desk. For software subscriptions, refund requests submitted within 14 days of renewal are eligible for review.

4. Community Forums & Acceptable Use

Our Community Forums are open to everyone for collaborative, respectful discussions. You agree not to post content that is abusive, harassing, defamatory, vulgar, spammy, or infringes on copyright. We reserve the right to moderate, hide, or remove any forum post and suspend accounts violating community standards.

5. Intellectual Property

All content, brand assets, logos, software engines, user interface designs, and visual styles on this site are the exclusive property of Enchackal Technologies LLC and protected under United States and international copyright, trademark, and trade secret laws.

6. Limitation of Liability

To the maximum extent permitted by law, Enchackal Technologies LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our software, website, or store items. In no event shall our total aggregate liability exceed the total amount paid by you in the 12 months preceding the claim.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising under these Terms shall first be attempted to be resolved amicably through good-faith customer support discussions.
